South Africa has no specific regulations at national and provincial levels on outsourcing of government services, but the following regulations needs to be observed in terms of government procurement.

• Public Finance Management Act, No.1 of 1999 (applying to procurement by national and provincial governments)
•Local Government: Municipal Finance Management Act, No.56 of 2003 and Local Government: Municipal Systems Act, No.32 of 2000 (applying to outsourcing and procurement by local governments)
• Preferential Procurement Policy Framework, Act, No. 5 of 2000 (in case of holding the bidding/competition process, choose service providers)
• Promotion of Administrative Justice Act 3 of 2000, to promote decision-making of public departments
• Black Economic Empowerment
