South Africa has no specific regulations at national and provincial levels on outsourcing of government services, but the following regulations needs to be observed in terms of government procurement.

Constitution of the Republic of South Africa, 1996 (section 217)

Public Finance Management Act, No.1 of 1999 (applying to procurement by national and provincial governments)

Local Government: Municipal Finance Management Act, No.56 of 2003 and Local Government: Municipal Systems Act, No.32 of 2000 (applying to outsourcing and procurement by local governments)

Preferential Procurement Policy Framework, Act, No. 5 of 2000 (in case of holding the bidding/competition process, choose service providers)

Promotion of Administrative Justice Act 3 of 2000, to promote decision-making of public departments
